    Refund Policy

    Operator: CyberSoftware (the "Company", "we", "us"). Service: CyberStock, cyberstock.lol.

    CyberStock is an online software and digital processing service. Payment processing, AI compute, storage, bandwidth, and third-party delivery costs are incurred by us the moment access is granted and processing begins, and those costs are not recoverable once spent. Our pricing is set on that basis.

    This Refund Policy is the complete and authoritative statement of when a refund is available. It forms part of, and is incorporated into, the Terms of Service. Where the Terms and this Policy address the same subject, this Policy governs refunds and the Terms govern everything else.

    Nothing in this Policy excludes, restricts, or modifies any right or remedy you have under applicable law that cannot lawfully be excluded, restricted, or modified. Where mandatory local law gives you more than this Policy does, that law applies.

    1. Cancellation and refund are different things

    Cancelling stops future renewals. It does not reverse, refund, or pro-rate a charge that has already been made, and it does not shorten the billing period you have already paid for.

    You can cancel at any time from your billing settings. Access normally continues until the end of the paid period. Whether any completed charge is refundable is decided solely under this Policy.

    Not cancelling before a scheduled renewal does not, on its own, make the renewal charge refundable. Renewal dates are shown in your account and in our renewal notices; keeping track of them is your responsibility.

    2. What we sell, and when it is delivered

    We sell access to software and a quantity of processing capacity, not a physical good and not an outcome. Specifically:

    • Subscriptions are delivered in full the moment your account is provisioned for the billing period — that is, when the plan's features, allowances, and credits become available to you. Delivery is not measured by how much of the period you choose to use.
    • Credits are delivered the moment they appear in your balance. They are consumed operation by operation as you use the Service.
    • Processing is delivered when a session completes and metadata, scores, exports, generated assets, or deliveries are made available to you — whether or not you subsequently accept, edit, export, or publish them, and whether or not a third-party agency accepts them.

    We do not sell, and do not warrant, acceptance by any stock agency, any level of sales, any Selling Score outcome, or any particular commercial result. Dissatisfaction with results after delivery is not a delivery failure and is not a ground for a refund outside §3 and §5.

    3. Immediate performance and the statutory withdrawal period

    If you are a consumer in the EU/EEA, the United Kingdom, Norway, or Switzerland, you normally have a statutory period (typically 14 days) within which you may withdraw from a distance contract.

    When you purchase, you are asked to give your express consent to performance beginning immediately — you want access and processing to work at once rather than after a waiting period — and to acknowledge that you lose your right of withdrawal once the service has been fully performed. Your consent and acknowledgement are recorded with your purchase.

    Where you gave that consent, the withdrawal right does not entitle you to a refund for a service already performed. Where you withdraw within the period and performance has begun but is not complete, you are liable for the proportion of the service actually supplied to you, including credits consumed and processing performed, and any refund is reduced accordingly.

    This section describes how the statutory right interacts with immediate delivery. It does not remove any right you have where consent was not given or where local law provides otherwise.

    4. First-Use Guarantee — first monthly subscription only

    Beyond your statutory rights, we voluntarily offer one opportunity to evaluate the Service and change your mind.

    The First-Use Guarantee applies only to a customer's first paid monthly CyberStock subscription charge. A refund of that charge may be requested within 30 days of it if, at the time of the request, either:

    • you have not processed any paid session; or
    • you processed no more than one First-Use Session and are not satisfied with the results.

    A First-Use Session is the first processing session submitted on the account, containing no more than 10 assets.

    The First-Use Guarantee ends, permanently, as soon as any of the following is true:

    • more than one processing session has been processed;
    • more than 10 assets have been processed;
    • credits or other paid processing resources beyond the First-Use Session have been consumed — including metadata generation, batch processing, deliveries to agencies, Studio generations, or other paid tools;
    • a delivery to any third-party platform has been performed; or
    • the 30-day period has expired.

    The First-Use Guarantee is available once per customer. It is not available for a second or subsequent account, and we may treat accounts sharing an email alias, payment instrument, billing identity, device, or household as one customer for this purpose.

    It does not apply to renewals, annual plans, credit packs, add-ons, or any purchase other than a first monthly subscription charge.

    5. Monthly renewals

    Renewal charges on a monthly subscription are not eligible for a refund under this voluntary programme, whether or not you used the Service during the renewed period, and whether or not you intended to cancel before the renewal date. Cancel at any time to prevent the next renewal.

    6. Annual subscriptions

    An annual subscription is a prepaid twelve-month commitment. Its price, included allowances, and any promotional or grandfathered rate are granted specifically in exchange for that commitment and are materially better than the monthly equivalent for the same access.

    Initial annual charges and annual renewal charges are not eligible for a refund under this voluntary programme, in whole or in part, used or unused, and are not pro-rated. Cancelling an annual subscription prevents the next renewal; it does not end or refund the current prepaid term, and access normally continues to the end of that term.

    This section applies to annual charges made on or after the date at the top of this page. For an earlier annual charge, the refund terms presented to you at checkout for that purchase apply — see §13.

    7. Credit packs, top-ups, and prepaid credits

    • Credit packs and top-ups are final and non-refundable once delivered to your balance.
    • Credits that have been used, partially used, held for a running job, or otherwise allocated to processing cannot be refunded, and a pack cannot be refunded once any credit from it has been consumed.
    • Credits are a prepaid entitlement to use the Service. They are not money, carry no cash value, earn no interest, are not transferable or redeemable for cash, and are not property or a stored-value instrument.
    • Bonus, promotional, referral, goodwill, and compensation credits are never refundable in cash under any circumstances.

    If purchased credits are not delivered because of a billing or technical error on our side, we will correct the balance, or where correction is not possible, refund the affected charge.

    8. How a session and an asset are counted

    A session is a processing batch or job recorded as a single session in our systems. Multiple assets processed within one session remain one session; individual files are not separate sessions merely because they were processed together. A draft in which no asset was submitted for paid processing is not a processed session.

    An asset is any image, video, or other file submitted for paid processing. An asset re-processed, regenerated, or re-delivered counts each time it is processed. Our account, processing, credit, delivery, export, and transaction records are the record of what happened, and we may review them in full when determining eligibility.

    9. Refunds are not available for

    Except where mandatory law requires otherwise, we do not provide voluntary refunds for:

    • monthly renewal charges;
    • annual charges or annual renewals, used or unused;
    • credit packs or top-ups after delivery;
    • the unused portion of any already-paid period;
    • requests made after the applicable window has closed;
    • usage beyond the First-Use Guarantee limits, or a second request under it;
    • failure to cancel before a renewal date;
    • change of mind once you are no longer eligible under §3 or §4;
    • dissatisfaction after substantial use of the Service;
    • rejection, removal, penalty, throttling, suspension, or termination of your account by any third-party stock agency or platform, for any reason, including their rules on AI-generated content, metadata quality, or automation;
    • reduced throughput applied under our Fair Usage Policy, or any consequence of that policy;
    • outages, latency, deprecations, price changes, or content refusals by third-party providers we depend on;
    • your own configuration, credentials, connection settings, chosen options, or deletion of your own data;
    • suspension or termination of your account for breach of the Terms, abuse of promotional pricing, or circumvention of limits, in which case any remaining balance and access may be forfeited; or
    • results that are lawful and delivered but not to your taste, including metadata wording, keyword selection, scores, or generated imagery.

    10. Technical problems — remedies in kind first

    If something does not work, contact support@cyberstock.lol and we will investigate. Where a verified fault on our side caused a paid operation to fail or to consume credits without producing a result, our remedy is, at our election:

    • restoring the incorrectly consumed credits;
    • re-processing the affected assets at no further charge;
    • correcting the affected account state; or
    • extending the affected billing period.

    These remedies are the primary and preferred remedies, and are provided instead of a cash refund except where mandatory law requires otherwise or where we are unable to supply the paid service at all. Credits already restored or work already re-processed for an incident are taken into account against any further claim for the same incident.

    11. Duplicate, incorrect, or unauthorised charges

    If you believe you were charged twice, charged the wrong amount, charged after a confirmed cancellation, or did not authorise a transaction, email support@cyberstock.lol promptly with the transaction details. Verified billing errors are corrected and are handled separately from the voluntary eligibility rules above.

    Please contact us before disputing a charge with your bank or card issuer. Practically every billing question is resolved faster by email than by a dispute, and a dispute freezes the funds while it runs.

    Initiating a chargeback for a charge that is not refundable under this Policy, or without first contacting us, is a material breach of the Terms. In that event we may suspend or terminate the account, revoke and forfeit any remaining credits and promotional pricing, decline future service, and recover the disputed amount together with any dispute fees and reasonable costs to the extent permitted by law. We respond to disputes with our records, including your policy-acceptance record, processing history, and delivery logs.

    12. How to request a refund

    Email support@cyberstock.lol within the applicable window, from the address on your account, including:

    • the email associated with your CyberStock account;
    • the charge or transaction concerned, and its date;
    • which ground you are relying on; and
    • a brief description of the problem.

    We aim to respond within five business days. We may ask for information reasonably needed to verify eligibility, and we may decline a request we cannot verify.

    Approved refunds are issued in the original currency to the original payment method only. We are not responsible for the time your bank or provider takes, for currency-conversion differences, or for fees charged by your own payment provider. Repeated or patterned refund requests across purchases or accounts may be refused, and may result in termination.

    13. Which version applies

    The version of this Policy in effect when a charge was made governs that charge, together with any refund terms expressly presented to you at checkout for that purchase. We may change this Policy at any time for future charges; changes are not applied retroactively to charges already made.
